These Terms of Service ("Terms") govern your access to and use of the Handolf website and your purchase of products from Handolf.
Handolf is operated by Kto Robyr Brands, a Swiss sole proprietorship owned by Cyril Robyr, Brühlgartenstrasse 12, 8400 Winterthur, Switzerland.
By accessing the website, placing an order, or otherwise using our Services, you agree to these Terms.
1. Online Store Terms
You may use the Services only for lawful purposes and in accordance with these Terms.
You may not use our products or Services for any illegal or unauthorized purpose or violate applicable laws in connection with your use of the Services.
You must not transmit malicious code, interfere with the security or operation of our website, attempt unauthorized access, scrape the Services in an abusive manner, or use the Services to infringe the rights of Handolf or any third party.
2. Eligibility
By placing an order, you represent that you are legally capable of entering into a binding agreement or that you have the permission of a parent or legal guardian where required by applicable law.
3. Products
We make reasonable efforts to display our products, colors, materials, dimensions, and images accurately.
However, colors and appearance may vary depending on your device, screen settings, manufacturing variations, and lighting.
Minor variations that do not materially affect the intended use of a product may occur.
We reserve the right to modify or discontinue products and to limit quantities where permitted by law.
4. Prices
Prices are displayed in the currency indicated on the website.
We may change prices at any time before an order is placed.
Price changes will not affect orders that have already been accepted.
We make reasonable efforts to ensure that product and pricing information is accurate. If an obvious pricing or technical error occurs, we may contact you before fulfilling the order and, where permitted by law, cancel and refund the affected order.
5. Orders and Acceptance
Submitting an order constitutes an offer to purchase the products in your order.
Receiving an automated order confirmation does not necessarily mean that the order has been accepted.
We may refuse or cancel an order for legitimate reasons, including suspected fraud, payment failure, product unavailability, obvious pricing errors, or restrictions on delivery.
If we cancel an order after payment has been received, the applicable amount will be refunded.
6. Payment
You agree to provide current, complete, and accurate billing and payment information.
Payments are processed by Shopify and/or third-party payment providers.
Available payment methods are displayed during checkout.
You authorize the applicable payment provider to charge the total amount shown at checkout.
7. Taxes, Duties and Import Charges
Applicable taxes collected by Handolf will be displayed at checkout where required.
Some products may be shipped internationally, including from fulfillment facilities outside the United States.
International shipments may be subject to customs procedures, duties, taxes, fees, or other governmental charges.
Where such charges are not expressly stated as included at checkout or in the applicable shipping method, they may be imposed separately by the carrier or competent authority.
8. Shipping and Delivery
Shipping and delivery are governed by our Shipping Policy, which forms part of these Terms.
Delivery dates and transit times are estimates unless explicitly stated otherwise.
Factors outside our reasonable control, including customs processing, carrier delays, severe weather, public holidays, transportation disruptions, or inaccurate delivery information, may affect delivery.
Nothing in these Terms limits any right you may have under mandatory consumer law if an order is not shipped or delivered as legally required.
9. Returns and Refunds
Returns and refunds are governed by our Refund & Return Policy, which forms part of these Terms.
Our standard return period is 100 days from delivery, subject to the conditions stated in that policy.
10. Promotional Offers
Discounts, promotional codes, gifts, bundles, or other offers may be subject to additional conditions stated at the time of the promotion.
Unless otherwise stated, promotional offers may not be combined.
We may modify or end a promotion prospectively, but doing so will not affect an order already validly accepted under that promotion.
11. Intellectual Property
All trademarks, logos, brand names, graphics, photographs, videos, website designs, product descriptions, text, and other content owned by Handolf or licensed to us are protected by applicable intellectual property laws.
You may use the website only for personal and non-commercial purposes unless we give you written permission otherwise.
Nothing in these Terms transfers any intellectual property rights to you.
12. Reviews and User Content
If you submit a review, image, feedback, suggestion, or other content to us, you represent that you have the right to provide that content.
You grant Handolf a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute that content in connection with operating and marketing Handolf, subject to applicable law.
We may remove content that is unlawful, misleading, abusive, infringing, or otherwise inappropriate.
13. Third-Party Services and Links
Our Services may contain tools, integrations, or links provided by third parties.
We are not responsible for independent third-party websites, services, terms, content, or privacy practices.
Your use of third-party services may be subject to separate terms.
14. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services and website are provided on an "as available" basis.
Nothing in these Terms excludes warranties, guarantees, remedies, or consumer rights that cannot legally be excluded.
Products remain subject to any mandatory legal rights applicable to your purchase.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Handolf, Kto Robyr Brands, Cyril Robyr, and our service providers will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from your use of the Services or purchase of products.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability that cannot legally be waived.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold Handolf harmless from claims arising directly from your unlawful use of the Services, your material breach of these Terms, or your infringement of third-party rights.
This section does not apply to the extent prohibited by applicable consumer law.
17. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain effective.
18. No Waiver
Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.
19. Governing Law
These Terms and our contractual relationship are governed by the laws of Switzerland, without regard to conflict-of-law principles.
However, this choice of law does not deprive consumers of mandatory protections that apply to them under the laws of their place of residence.
To the extent legally permissible, disputes shall be subject to the competent courts in Switzerland. Mandatory consumer jurisdiction rules remain unaffected.
20. Changes to These Terms
We may update these Terms from time to time.
The version applicable to an order is generally the version in effect when that order was placed, subject to applicable law.
